Warranty General Conditions and right of withdrawal, return conditions

  • Warranty Conditions:
  • Online purchases, as well as in-store ones, are covered by a warranty on purchased products, for defects in production expected by law as per art 53 D.Lgs. 6 Settembre 2005 n.206. Warranty covers defectsof manufacturing and production and is not applied, by law, on anomalouos usage of the products or use for different than indicated purpose. In general, unless otherwise indicated, products have a producer coverage of 24 months which can be activated by registering the product on producer's website. If there is any problem with the product, the customer can contact us through our email address [email protected] or by our contact module, indicating order number or number of receipt/invoice related to the order. Genial Motor will take care to act as intermediary between the customer and the producer during warranty assistance procedure, indicating the buyer which steps to follow to resolve the found issue, unless the prducer itself will not take care of the case in first person. Every producer has different methods to resovle requests of warranty assistance, for which the customer is invited to remain in touch both with the producer and the seller, regarding status of his request and to provide a valid mean of contact at which he could be reached if needed. Due to the fact warranty assistance requests are elaborated by producers directly, Genial Motor is not responsible for delays caused by repair or replacement of the product which has been sent in warranty.

  • Right of withdrawal:
  • The customer has the right, within 60 calendar days from item reception (tracking information are taken as relevant proof) to exercise his right of withdrawal for purchased product. To exercise his right of withdrawal for a change of mind, the customer has to send written communication to our addresses within and not over 60 calendar dats from item reception and to proceed hence to item shipment at his charge, with tracked shipment, within and not over 60 calendar days from item reception. At the moment of shipment, it is required to include inside the item package a copy of his receipt/invoice or a written summary in order to allow our returns office to track the package and the RMA number. At the moment the item is received from return, a refund will be issued with the same payment method the customer used to complete his order (for cash on delivery orders, refund will be issued via banking transfer). Refund will regard item cost and shipment costs where the item has no free shipment. Shipment supplements for express delivery will not be counted in any case for refund. According to current regulation, Genial Motor reserves the right to issue partial refunds or deny withdrawal where item have been returned used, damaged or not packed in the original packaging, according to what is indicated in Customer's Code regarding right of withdrawal and of course with the customer being informed by the seller. Any shipment cost for items which is to be sent to the customer in case product withdrawal is denied will be at customer's charge. Products which are excluded from right of withdrawal are items made on request or clearly customized, perishable goods, sealed goods wich have been opened after delivery, goods returned in different conditions than the original ones.

  • Return for non compliant products:
  • in case a delivered item is not compliant to specification, arrives damaged or missing of some parts, it is possible to return it for a refund or a replacement. The customer has to inform Genial Motor within and not over 60 calendar days from item reception about found defect; After request, the item will be collected from Genial Motor at its charge at the address used for shipment of the order and refunded or replaced according to customer's request. In case there are some parts missing from the product package, Genial Motor will provide sending missing parts with no further costs in charge at the customer, as soon as possible and according to availability and ETA if spares are not available immediately. In case of return for non-compliant or damaged item with refund purpose, same payment method of the order will be used (for cash on delivery orders, banking transfer will be used); in case of return with replacement purpose, this will take place without any expense in charge at the customer, as soon as possible and according to availability and ETA of the replacement, if not available. in every case, the customer has to provide one or more addresses at which he can be reachable for any communication.
